Instead of having each biome determine whether water with sky access will freeze into ice as a yes or no question, why not make it based upon the biomes' temperature setting? The temperature would determine the minimum Y-level that water must be, with open sky access and minimal light, before it can freeze into ice. For cold temperatures, water will freeze like it normally does, pretty much any Y level. For normal temperatures, you have to go some elevation above ocean level, perhaps that can be a gamerule. For hot temperatures, you need twice as much elevation above ocean level as normal biomes. For those who don't wish any of this to occur, there could be a toggle gamerule that disables this mode, since I know some people like to build in biomes where water doesn't freeze for aesthetic purposes. Similarly, this could also control when snow starts in the given biome, allowing biomes that never had snow before to get snow provided you were high enough. All of this will also help those on Superflat worlds gain the ability to get Snow and Ice, since most of them play in Plains biomes, thus can't get those resources. Making this a set of gamerules would allow players to opt-in/out (depending upon the default setting) of this.
