The Phantom is an.. interesting mob to say the least. I have a love-hate relationship with it, (mostly hate but complaining about it won't solve anything XD) however I will admit it is an incredibly cool idea. It also adds a neat challenge to the game by having to make sure your character isn't too tired. However, I do feel that their current spawning mechanics are a little finicky. Allow me to propose an alternate spawning mechanic:
Currently, they spawn based on whether or not a player has slept for more than 3 in-game days. This isn't too much of an issue to making them not spawn because you just have to sleep every now and again, however what if you DO want them to spawn? Currently, their drop is the repair item for the Elytra, so whether or not you like or hate this mob, you have to hunt for them eventually. (for those of you who say "just use Mending," they also are the ingredient for Slow Falling potions) So, in reality they're quite rare during normal gameplay where you probably sleep regularly. So, I have a different idea.
I feel they should spawn based on moon phase. The moon phases affect a few things currently, for example Slime spawns, Spider potion effect chances, and also how often mobs spawn with gear. So for the Phantom, the fuller the moon, the more of a chance they have of spawning, much like the Slimes. (also, they won't spawn on a new moon, like the Slimes)
Their behavior remains unchanged other than the fact that they are neutral to players. They will be hostile, however, if you haven't slept for more than 3 in-game days or if you attack it. Much like the Zombie Pigmen, if you attack it, other Phantoms near it will become angry as well.
One more thing. Due to the fact this would make them spawn more often, they shouldn't be able to spawn in packs. Currently, they spawn in packs of 1-4 Phantoms above players who haven't slept. If non-sleeping players aren't a factor anymore, (or less of a factor as non-sleeping players could still have an influence on spawning) there should be less Phantoms that spawn so there won't be hundreds of them flying around. This way it would counteract the fact that they would spawn more often to still keep a balance of how many are currently flying around.
